Understanding Maintenance Rights in Indian Family Courts

Maintenance rights in India are governed by various statutes including the Hindu Adoption and Maintenance Act, 1956, Section 125 of the Criminal Procedure Code, and the Code of Criminal Procedure.

Types of Maintenance

1. Interim Maintenance (Pendente Lite)

During the pendency of a divorce or matrimonial case, either spouse can claim interim maintenance to meet their daily expenses. This is governed by Section 24 of the Hindu Marriage Act.

2. Permanent Alimony

After the final decision in a matrimonial case, the court may grant permanent alimony based on various factors including the income and property of both parties.

3. Maintenance Under Section 125 CrPC

This is a provision for any person who is unable to maintain themselves, including wives, children, and parents.

Who Can Claim Maintenance?

  • Wife: A wife can claim maintenance from her husband if she is unable to maintain herself
  • Husband: Under certain circumstances, a husband can also claim maintenance
  • Children: Minor children can claim maintenance from their parents
  • Parents: Elderly parents can claim maintenance from their children

Factors Considered by Courts

When deciding maintenance amounts, courts consider:

  1. Income and financial status of both parties
  2. Standard of living during the marriage
  3. Age and health of the claimant
  4. Number of dependents
  5. Educational qualifications and employability

Procedure to Claim Maintenance

  1. File an application in the appropriate family court
  2. Provide evidence of marriage and financial status
  3. Attend hearings and provide required documents
  4. The court may grant interim maintenance pending final decision
